Apple customers being notified of $53 million settlement in iPod, iPhone class action case over warranty claims

Earlier this year, Apple agreed to pay $53 million to resolve a class-action lawsuit based on allegations of faulty moisture indicators in Apple’s older iOS devices. The suit alleges that the indicators were defective and falsely interpreted that the iPhone and iPod had been damaged by water. As a result, according to the suit, Apple unjustly denied customer warranty claims.

The court overseeing the lawsuit has scheduled a hearing on January 29, 2014 to determine whether to finally approve the settlement. Meanwhile, eligible Apple customers are now being contacted via email about the proposed settlement and damages.

Under the terms of the settlement, if Apple denied warranty coverage for your iPhone on or before December 31, 2009, or for your iPod touch on or before June 30, 2010 because Apple stated that your iPhone or iPod touch had been damaged by liquid, you may eligible to a cash refund. The deadline to submit a claim form online is 9:00 p.m. Pacific time on October 21, 2013 or by mail postmarked no later than October 21, 2013. The suit alleges that Samsung advertised the Galaxy S4 as having significantly more storage capacity than what was actually available on the device. Consumers who purchased the 16 GB Galaxy S4 were unaware that the actual available memory on the phone was only about half the advertised capacity of the device and far less than other similar devices, according to the lawsuit.
