Automotive Defects

Heygood, Orr & Pearson has successfully represented thousands of clients who purchased or leased diesel vehicles with excess NOx emissions.  Auto manufacturers marketed these vehicles as “clean” and “emissions compliant” even though the vehicles were equipped with defeat devices used to conceal excess emissions.

Volkswagen “Clean Diesel” Litigation

We have represented individual consumers and class members in the Volkswagen “Clean Diesel” diesel emissions litigation.  This case involved hundreds of thousands of vehicles marketed as “clean” diesels that had defeat devices designed to conceal excess NOx emissions.  Our firm was appointed to the plaintiffs’ steering committee in the Volkswagen “Clean Diesel” federal MDL.  We also served as class counsel and were involved in litigating the class action and obtaining a multi-billion dollar class action settlement for consumers.

Our firm also successfully represented approximately 2,000 consumers who opted out of the class settlement to pursue individual claims against Volkswagen and Audi.  We litigated the opt-out cases in multiple jurisdictions and ultimately obtained favorable settlements for our clients.  Heygood Orr & Pearson attorney Charles Miller served as co-liaison counsel in JCCP No. 4848, the California coordinated state-court proceeding for these cases.

FCA EcoDiesel Litigation

Our firm successfully represented approximately 1,200 individual consumers in the FCA EcoDiesel emissions litigation involving diesel Ram truck and Jeep Cherokees equipped with “EcoDiesel” engines.  Like the Volkswagen case, the diesel Rams and Cherokees had defeat devices designed to conceal excess emissions from consumers and regulators.  We successfully represented and negotiated settlements for individual consumers in the federal MDL and a related coordinated proceeding in Texas state court.

Mercedes Emissions Litigation

Heygood Orr & Pearson successfully represented approximately 3,800 individual consumers in the Mercedes emissions litigation.  This case involved Mercedes vehicles equipped with defeat devices used to hide excess diesel emissions.  We represented and negotiated favorable settlements for these clients.

GM Duramax Emissions Litigation

Our firm currently represents approximately 2,700 individual consumers in the GM Duramax emissions litigation.  This case is pending in a Michigan federal court and involves GM Duramax diesel trucks with excess NOx emissions.
