Water Damage Lawsuit Filed On Behalf of Texas Homeowner by Heygood, Orr & Pearson

A lawsuit on behalf of an Austin, Texas homeowner whose property suffered water damage and flooding as a result of runoff from his neighbor’s property has been filed by the law firm of Heygood, Orr & Pearson. Court of appeals affirms certification of class action by life settlement investors against Life Partners, Inc.

A life settlement is the sale of an existing life insurance policy by the policyholder (who is typically an ill and/or elderly person) to another party. The policy is sold at a discount to the face amount. The policyholder receives a cash payment while the purchaser takes an ownership interest in the policy. The purchaser then receives the full amount of the death benefit paid out under the policy when the insured dies. Life settlements investments are often purchased by a group of investors who each buy only a fractional interest in a given policy. The purchasers also pay premiums as due to keep the policy in force until the policy matures. Read the full article…

HO&P files Mississippi pain patch lawsuit on behalf of woman who died from fentanyl overdose

In June of 2010, a Mississippi woman’s doctor wrote her a prescription for four 25 mcg fentanyl patches. She had the prescription filled the next day at her local CVS Pharmacy. However, rather than filling the prescription with the 25 mcg fentanyl patches that were prescribed, CVS filled the prescription with four 75 mcg Sandoz patches—three times the dose that the doctor had intended to prescribe. HO&P files wrongful death lawsuit on behalf of Texas man whose wife died when flesh-eating bacteria was not diagnosed

A Dallas, Texas-area woman bumped her arm against a railing one day a couple years ago. She did not immediately experience significant pain; however, over the next two days, her arm gradually swelled, grew increasingly sore and became discolored. Class action lawsuit filed by HO&P against Life Partners, Inc. will move forward following federal appeals court ruling

Heygood, Orr & Pearson is currently pursuing a putative class action lawsuits against Life Partners, Inc., a company that specializes in “life settlement” investments. A “life settlement” is the sale of an existing life insurance policy by the policyholder to another party. By selling a life insurance policy, the policyholder receives an immediate cash payment while the purchaser takes an ownership interest in the policy at a discount to its face value and later receives the full amount of the death benefit paid out under the policy when the insured dies. The less that a life settlement purchaser pays to the insurer prior to the policy maturing, the greater the yield on the investment. Read the full article…

HO&P Files Truck Accident Lawsuit Against Kenworth Truck Company Following Rollover and Death

In early 2011, the husband and father of our clients was at work operating a Kenworth truck on a gas well construction site in Fort Worth, Texas. The truck had been fitted with a water tank and was being used to spray water to wet down the construction site. TEXAS SUPREME COURT HANDS HOP’s CLIENT MAJOR VICTORY

Heygood, Orr & Pearson is representing the City of Brownsville (and the City’s Public Utilities Board) in a lawsuit against AEP Texas Central Company (“TCC”) arising from the purchase of an electric power plant.  Among other claims, the City contends that TCC breached a purchase and sale agreement by failing to close the sale in a commercially reasonable and timely manner.  Brownsville is suing to recover more than $30 million in damages resulting from TCC’s breaches.
