Louisiana woman awarded $51.5 million verdict in trucking accident lawsuit

A Louisiana jury has awarded a $51.5 million verdict to a New Orleans woman who was severely injured in an accident involving a tractor trailer truck. Connie Jones Marable was severely injured in 2012 in a truck accident at a Lowe’s parking lot in New Orleans East.

According to the lawsuit filed on her behalf, Marable’s husband, Wayne, had left his 2007 Freightliner truck in the Lowe’s parking lot with the parking brake on before the accident occurred. When the truck began moving forward unexpectedly, Marable attempted to help her husband stop the vehicle.

Marable was pinned and dragged under the truck’s wheels, causing “crushing physical injuries and a severe brain injury”. As a result of these injuries, she has been under “minimally conscious state under 24-7 nursing care” since the accident.

Marable’s children filed a lawsuit against the company that owns Freightliner, Daimler Trucks North America LLC, as well as Marable’s husband’s insurance company and his employer, KLLM Transport Services LLC. Marable’s attorney stated that the jury found Daimler 90% at fault in the accident, saying that a defective parking brake system on the Freightliner truck caused the accident. The $51.5 million verdict is one of the largest ever awarded to a single plaintiff in Orleans Parish Civil District Court, where the case was heard.
