Texas woman files lawsuit against trucking company, driver over injuries from Austin gravel truck accident

A Texas woman who was injured in an accident with a gravel truck near Austin has filed a lawsuit against the driver of the vehicle and the trucking company that owns it. Delaney Nelson alleges that she suffered “life-altering injuries” as a result of a collision involving a truck owned by Franco’s Trucking.

According to her lawsuit, Nelson was driving on RM 2222 in west Austin when her car was t-boned by a gravel truck being driven by Codie Korn, an employee of Franco’s Trucking. Prior to the accident, Korn’s truck began bouncing, forcing him to pull over to the side of the road. As he continued down the road, his truck struck a Honda waiting at a stoplight before colliding with Nelson’s vehicle and a third car. Nelson suffered spinal injuries as well as cuts on her face and ears from broken glass as a result of the accident, her attorney said.

Nelson’s lawsuit accuses Korn of operating the truck in an unsafe manner and failing to keep a proper lookout while he was driving the gravel truck. The lawsuit also accuses Franco’s Trucking of negligence for hiring Korn as a driver. Prior to being hired, Korn was convicted of driving under the influence and driving without a valid license. Nelson’s attorney argued that these driving infractions should have disqualified him from being hired as a truck driver.

Federal safety records show that Franco’s Trucking was found to have committed a number of violations in the past two years. According to the Federal Motor Carrier Safety Administration, Franco’s Trucking had been cited for 20 violations during this period, including one that involved a crash.
